Minimum Energy Efficiency Standards (MEES) For Landlords

 

The Domestic Minimum Energy Efficiency Standards (MEES) were introduced by the government in 2018 to:


  1. Improve the quality of PRIVATELY RENTED PROPERTIES in England and Wales,
  2. To increase the energy efficiency of the worst performing properties,
  3. To improve the comfort and conditions in privately rented properties and reduce fuel poverty.


Currently, privately rented properties must achieve an Energy Performance Certificate (EPC) rating of at least an 'E'. The legislation prevents landlords from renting out a property with a rating of 'F' or 'G'. This applies to new and existing tenancies.


Local authorities in England and Wales can apply for funding from the Department for Business, Energy and Industrial Strategy (BEIS) to support MEES enforcement. Under these regulations, they can serve landlords with a compliance notice and issue you a fine of up to £5,000 per property.


You also need to know, that buy-to-let mortgage lenders will not accept purchase or re-mortgage applications where a property does not meet the legally required EPC standards.

LANDLORDS - Are you ready?


The Government has committed to long term plans on the improvement of energy efficiency in privately rented homes. They are proposing  to raise the minimum EPC rating to 'C' for all newly rented properties on the market from the start of 2025. 


Existing tenancies will be given until 2028 to comply. 


Properties that cannot be improved to meet the minimum rating, may be 'EXEMPT' from MEES regulations.


Exemptions will need to be correctly categorised as:


  • high cost exemptions
  • seven-year payback exemptions
  • all improvements made exemptions
  • wall insulation exemptions
  • consent exemptions
  • devaluation exemptions
  • new landlord exemptions

You will be legally obliged to carry out energy efficiency improvement work up to a Landlord price cap of £3,500. If the property is still below an 'E' rating, it will need to be correctly registered on the exemption register.
